The bankruptcy code limits the amount of debt that a person may have in their chapter 13 bankruptcy in 11 U.S.C § 109.
The code provides that the chapter 13 income limits shall be adjusted every three years on April 1st along with certain exemption amounts. Unfortunately, Florida has opted out of the Federal Exemptions so Florida residents will not be able to benefit from the increase to the Federal Exemptions unless they moved to the state within 730 days of filing their case.
However, the Judicial Conference of the United States has announced that the these new chapter 13 limits begin April 1, 2022:
- Unsecured Debt: $465,275
- Secured Debt: $1,395,875.00
This increases the current unsecured limit by $25,00.00 and increases the current secured limit by $138,025.00 which is excellent for future chapter 13 cases.
